1. Information We Collect

a. Information You Provide:

  • Account Information: When you create an account, we collect your email address, which is essential for identifying your active subscription, managing your account, and ensuring continued access to your benefits. You may also provide other optional account information.
  • Uploaded Content: We collect the images and any associated data you upload to the Service ("User Content").
  • Communications: If you contact us directly (e.g., for support or feedback), we may receive additional information about you such as your name, the contents of your message, and any other information you choose to provide.

b. Information Collected Automatically:

  • Usage Data: We may collect information about how you access and use the Service, such as your IP address, browser type, operating system, pages viewed, links clicked, and the dates and times of your visits. This may include data collected through analytics tools like PostHog.
  • Cookies and Similar Technologies: We may use cookies (small text files stored on your device) and similar tracking technologies to operate and improve the Service, understand usage, and for analytics purposes. You can typically configure your browser to refuse cookies, but this may limit some Service functionality. Read our Cookie Policy for more information.

c. Payment Information:

  • Payments are securely processed through Stripe. We do not directly collect, store, or process your full payment card details. All payment details, such as credit card numbers and billing information, are provided directly to Stripe and handled in compliance with their security standards (Stripe Legal, Stripe Privacy Center). Stripe provides us with transaction confirmation and limited information (e.g., last 4 digits of a card, card type) for verification and billing management.

2. How We Use Your Information

We use the information we collect for various purposes, including to: - Provide, operate, maintain, and improve the Service. - Process your transactions and manage your subscriptions. - Authenticate users, using services like Clerk for managing user authentication and account-related data securely. - Communicate with you, including responding to your inquiries, sending service-related announcements, and providing customer support. - Personalize and improve your experience on the Service. - Monitor and analyze trends, usage, and activities in connection with our Service (e.g., using PostHog for product analytics, Sentry for error tracking). - Ensure the security and integrity of our Service. - Comply with legal obligations and enforce our Terms of Use, including the Content Guidelines below.

3. Sharing and Disclosure of Information

We do not sell your personal information. We may share your information in the following circumstances:

  • Service Providers: We share information with third-party service providers who perform services on our behalf, such as:

    • Cloudflare: For DNS, CDN, security, and R2 object storage for User Content.
    • Vercel: For application hosting.
    • Stripe: For payment processing.
    • Clerk: For user authentication and account management.
    • PostHog: For product analytics and session replay (we strive to minimize personal data collection).
    • Sentry: For error tracking and performance monitoring.
    • Resend: For transactional email delivery. These providers are authorized to use your information only as necessary to provide these services to us and are obligated to protect your information.
  • Legal Requirements: We may disclose your information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

  • Business Transfers: If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our Service of any change in ownership or uses of your personal information.

  • With Your Consent: We may share your information for other purposes with your explicit consent.

4. Content Guidelines and Enforcement (Acceptable Use)

To maintain a safe, respectful, and lawful environment, you agree not to upload, post, store, or transmit any User Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
  • Harms or exploits minors in any way;
  • Contains nudity, pornography, or explicit or sexually suggestive content that violates applicable laws;
  • Violates applicable laws, including but not limited to those regarding child pornography and child sexual abuse material.

Enforcement: SnapiX may review User Content and reserves the right to flag, remove, or take other appropriate action regarding any content that violates these guidelines or our Terms of Use. This is to ensure compliance with applicable laws and to maintain the security and trust of our platform. In cases of detected violations:

  • We may immediately remove the offending content without prior notice.
  • We may disable or delete the accounts responsible for such content.
  • Unlawful content may be reported to the appropriate law enforcement authorities in compliance with legal obligations.

Your use of the Service and your User Content are subject to these guidelines.

5. Data Retention

We retain your personal data for as long as your account is active or as needed to provide you with the Service. We may also retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Typically, User Content you upload is retained until you delete it or terminate your account. Anonymized or aggregated data may be retained for longer periods for analytics and service improvement.

You may delete your data, respectively your account at any time by visiting the security section at the account page.

6. Security

We implement reasonable technical and organizational measures to protect your personal information from unauthorized access, use, disclosure, alteration, or destruction. As mentioned, payments are securely handled by Stripe, and user authentication by Clerk. However, no internet-based service can be 100% secure, so we cannot guarantee absolute security.

    • Legitimate interests: For our legitimate business interests, such as improving the Service, security, analytics, and customer support, provided these interests are not overridden by your data protection interests or fundamental rights and freedoms.

8. International Data Transfers

Your information, including personal data, may be transferred to - and maintained on - computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. If you are located in the EEA, UK, or Switzerland, this means your data may be transferred outside of these regions, for example, to servers or service providers in the United States. We will take appropriate safeguards to ensure that your personal data remains protected in accordance with this Privacy Policy and applicable law (e.g., by relying on Standard Contractual Clauses or adequacy decisions where applicable).

9. Children's Privacy

Our Service is not directed to individuals under the age of 16 (or the relevant age of consent in your jurisdiction). We do not knowingly collect personal information from children under this age. If we become aware that a child under this age has provided us with personal information, we will take steps to delete such information. We encourage you to periodically review this page for the latest information on our privacy practices.
