Welcome to SnapiX! These Terms of Use ("Terms") govern your access to and use of the SnapiX services, including our website, API, and any related content or software (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service and Parties
The Service is provided by Spas Z. Spasov operating as SnapiX ("SnapiX", "we", "us", or "our"). These Terms are a binding agreement between you (an individual or the legal entity you represent, "you") and SnapiX. If you are using the Service on behalf of an entity, you confirm you have the authority to bind that entity to these Terms.
Note for users: SnapiX is currently operated by an individual. Spas Z. Spasov is the entity you are contracting with.
2. Your Content and Our License
- Your Ownership: You retain all ownership rights to the images and data you submit to the Service ("Submitted Content") and to the images processed by the Service ("Processed Content").
- Our License: To provide and improve the Service, you grant SnapiX and its necessary third-party providers (like cloud storage) a non-exclusive, royalty-free, worldwide license to store, process, modify, and transmit your Submitted Content solely for the purpose of operating, providing, and improving the Service. This license ends when your content is deleted.
- Storage:
- Registered Accounts: Content is stored until you delete it or terminate your account, subject to our Privacy Policy.
- Anonymous Accounts: Up to 9 uploaded items are stored per session. All session data and images are purged after 168 hours (7 days) of inactivity.
- Backups: You are responsible for maintaining your own backups of your Submitted and Processed Content. SnapiX is not a backup service.
3. Using the Service
- Account: You may need to create an account to use certain features. You must provide accurate information and keep your account secure. You must be at least 16 years old (or the age of legal majority in your jurisdiction if older) to use the Service.
- Usage Limits: We may set limits on file sizes, request rates, or other aspects of Service use ("Usage Limits"). We can change these limits at any time.
- API Use: If using our API, you agree not to:
- Attempt to create a service that directly competes with SnapiX using our API.
- Bypass API rate limits through multiple accounts or other means.
- Acceptable Use: You agree not to use the Service to:
- Upload or process illegal, harmful, infringing, or offensive content.
- Transmit viruses or malicious code.
- Overburden, disrupt, or attempt to gain unauthorized access to the Service or its systems.
- Reverse engineer, scrape data from (except for public search engine indexing), or exploit vulnerabilities in the Service.
- Violate any applicable laws or these Terms.
- Enforcement: We reserve the right to remove content, suspend or terminate accounts, or deny access if you violate these Terms, at our discretion.
4. Payments, Subscriptions, and Refunds
- Pricing:
- Prices are listed in EUR for users in the EU and USD for all other users.
- Prices include applicable sales tax (like VAT) where legally required for us to collect.
- We reserve the right to change prices with at least 30 days' notice.
- Subscription Plans:
- Flexible-price (Pay-as-you-go): Billed monthly for the previous month's usage.
- Fixed-price (Prepaid): Billed at the start of each subscription period (e.g., monthly, yearly).
- Billing Authorization: You authorize us (and our payment processor, Stripe) to charge your chosen payment method for all due fees and taxes. Keep your payment information current.
- Payment Failures: If payment fails, we may retry or suspend your access to paid features until payment is made.
- Renewals: Fixed-price subscriptions automatically renew. You can disable auto-renewal at any time in your account settings. Your access will continue until the end of the paid period.
- Cancellation & Refunds:
- Disabling Auto-Renewal: Your subscription will end after the current paid term.
- Immediate Cancellation (Fixed-Price): You can cancel an active fixed-price subscription immediately. You may receive a prorated refund for unused time, excluding taxes. The refundable amount must exceed 1 EUR/USD.
- Non-Refundable: Credits, one-time purchases, and plans marked as non-refundable are not eligible for refunds unless required by law or at our sole discretion.

- Termination by SnapiX: We may terminate or suspend your account for violations of these Terms, with or without notice.
5. SnapiX's Intellectual Property
- Our License to You: During your subscription or session, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service as intended and according to these Terms.
- Our Ownership: SnapiX and its licensors own all rights, title, and interest in the Service itself, including its software, design, branding, and any improvements (excluding your Content). You may not use our trademarks or logos without our prior written permission.
- Feedback: If you provide feedback or suggestions, we are free to use them without any obligation or compensation to you.
6. Privacy and Data
- Data Collection: We collect minimal personal data (like email and account info) needed to provide the Service.
- Processing: Uploaded images, logs, and usage data are processed as described in our Privacy Policy to operate and improve the Service.
- Your Rights (e.g., GDPR): You have rights regarding your personal data (e.g., access, correction, deletion) as outlined in our Privacy Policy and under applicable data protection laws.
- Content Deletion: Upon account termination, we will take steps to delete your Submitted Content in accordance with our Privacy Policy and operational requirements.
7. Third-Party Services
We use third-party services to help provide SnapiX (e.g., Cloudflare for CDN/storage, Vercel for hosting, Stripe for payments, Clerk for authentication, PostHog for analytics, Sentry for error tracking, Resend for emails). While we select these services carefully, we are not directly responsible for their individual actions or failures, though your agreement for the Service remains with SnapiX. Our use of these providers is further detailed in our Privacy Policy.
8. Disclaimers and Limitation of Liability
- "AS IS" SERVICE: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
- NO GUARANTEE OF RESULTS: WE DO NOT WARRANT THAT THE QUALITY OR RESULTS OF THE IMAGE CONVERSION WILL MEET YOUR EXPECTATIONS.
- LIABILITY CAP: TO THE FULLEST EXTENT PERMITTED BY LAW, SNAPIX'S TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO SNAPIX FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50.00 USD) (OR EUR EQUIVALENT).
- NO INDIRECT DAMAGES: TO THE FULLEST EXTENT PERMITTED BY LAW, SNAPIX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, OR GOODWILL) ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
- Some jurisdictions don't allow certain disclaimers or limitations, so parts of this section may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless SnapiX (and its operator) from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of these Terms; (b) your Submitted Content infringing third-party rights; or (c) your misuse of the Service or violation of any law.
10. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will notify you (e.g., via email or an in-app notice) reasonably in advance. By continuing to use the Service after changes become effective, you agree to the new Terms. If you don't agree, you must stop using the Service.
11. Governing Law and Disputes
- Governing Law: These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict of law principles.
- Dispute Resolution: Any disputes arising from these Terms or the Service shall be resolved in the courts located in the courts located in Sofia, Bulgaria. You consent to the jurisdiction of these courts.
- Time Limit on Claims: You agree to file any claim related to the Service or these Terms within one year after the claim arose. Otherwise, the claim is permanently barred.
- (Optional: Class Action Waiver) You agree to resolve disputes with SnapiX only on an individual basis and not to bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. (Note: Enforceability of class action waivers varies by jurisdiction.)
12. General
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and SnapiX regarding the Service, superseding any prior agreements.
- Severability: If any part of these Terms is found to be invalid or unenforceable, the remaining parts will remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
- Force Majeure: We are not liable for delays or failures in performance caused by events beyond our reasonable control.
