Terms of Use

Wel­come to SnapiX! These Terms of Use ("Terms") gov­ern your ac­cess to and use of the SnapiX ser­vices, in­clud­ing our web­site, API, and any re­lat­ed con­tent or soft­ware (col­lec­tive­ly, the "Ser­vice"). By us­ing the Ser­vice, you agree to be bound by these Terms. If you do not agree, please do not use the Ser­vice.

1. The Ser­vice and Par­ties

The Ser­vice is pro­vid­ed by Spas Z. Spasov op­er­at­ing as SnapiX ("SnapiX", "we", "us", or "our"). These Terms are a bind­ing agree­ment be­tween you (an in­di­vid­ual or the le­gal en­ti­ty you rep­re­sent, "you") and SnapiX. If you are us­ing the Ser­vice on be­half of an en­ti­ty, you con­firm you have the au­thor­i­ty to bind that en­ti­ty to these Terms.

Note for users: SnapiX is cur­rent­ly op­er­at­ed by an in­di­vid­ual. Spas Z. Spasov is the en­ti­ty you are con­tract­ing with.

2. Your Con­tent and Our Li­cense

  • Your Own­er­ship: You re­tain all own­er­ship rights to the im­ages and data you sub­mit to the Ser­vice ("Sub­mit­ted Con­tent") and to the im­ages processed by the Ser­vice ("Processed Con­tent").
  • Our Li­cense: To pro­vide and im­prove the Ser­vice, you grant SnapiX and its nec­es­sary third-par­ty providers (like cloud stor­age) a non-ex­clu­sive, roy­al­ty-free, world­wide li­cense to store, process, mod­i­fy, and trans­mit your Sub­mit­ted Con­tent sole­ly for the pur­pose of op­er­at­ing, pro­vid­ing, and im­prov­ing the Ser­vice. This li­cense ends when your con­tent is delet­ed.
  • Stor­age:
    • Reg­is­tered Ac­counts: Con­tent is stored un­til you delete it or ter­mi­nate your ac­count, sub­ject to our Pri­va­cy Pol­i­cy.
    • Anony­mous Ac­counts: Up to 9 up­loaded items are stored per ses­sion. All ses­sion data and im­ages are purged af­ter 168 hours (7 days) of in­ac­tiv­i­ty.
  • Back­ups: You are re­spon­si­ble for main­tain­ing your own back­ups of your Sub­mit­ted and Processed Con­tent. SnapiX is not a back­up ser­vice.

3. Us­ing the Ser­vice

  • Ac­count: You may need to cre­ate an ac­count to use cer­tain fea­tures. You must pro­vide ac­cu­rate in­for­ma­tion and keep your ac­count se­cure. You must be at least 16 years old (or the age of le­gal ma­jor­i­ty in your ju­ris­dic­tion if old­er) to use the Ser­vice.
  • Us­age Lim­its: We may set lim­its on file sizes, re­quest rates, or oth­er as­pects of Ser­vice use ("Us­age Lim­its"). We can change these lim­its at any time.
  • API Use: If us­ing our API, you agree not to:
    • At­tempt to cre­ate a ser­vice that di­rect­ly com­petes with SnapiX us­ing our API.
    • By­pass API rate lim­its through mul­ti­ple ac­counts or oth­er means.
  • Ac­cept­able Use: You agree not to use the Ser­vice to:
    • Up­load or process il­le­gal, harm­ful, in­fring­ing, or of­fen­sive con­tent.
    • Trans­mit virus­es or ma­li­cious code.
    • Over­bur­den, dis­rupt, or at­tempt to gain unau­tho­rized ac­cess to the Ser­vice or its sys­tems.
    • Re­verse en­gi­neer, scrape data from (ex­cept for pub­lic search en­gine in­dex­ing), or ex­ploit vul­ner­a­bil­i­ties in the Ser­vice.
    • Vi­o­late any ap­plic­a­ble laws or these Terms.
  • En­force­ment: We re­serve the right to re­move con­tent, sus­pend or ter­mi­nate ac­counts, or deny ac­cess if you vi­o­late these Terms, at our dis­cre­tion.

4. Pay­ments, Sub­scrip­tions, and Re­funds

  1. Pric­ing:
    • Prices are list­ed in EUR for users in the EU and USD for all oth­er users.
    • Prices in­clude ap­plic­a­ble sales tax (like VAT) where legal­ly re­quired for us to col­lect.
    • We re­serve the right to change prices with at least 30 days' no­tice.
  2. Sub­scrip­tion Plans:
    • Flex­i­ble-price (Pay-as-you-go): Billed month­ly for the pre­vi­ous mon­th's us­age.
    • Fixed-price (Pre­paid): Billed at the start of each sub­scrip­tion pe­ri­od (e.g., month­ly, year­ly).
  3. Billing Au­tho­riza­tion: You au­tho­rize us (and our pay­ment proces­sor, Stripe) to charge your cho­sen pay­ment method for all due fees and tax­es. Keep your pay­ment in­for­ma­tion cur­rent.
  4. Pay­ment Fail­ures: If pay­ment fails, we may retry or sus­pend your ac­cess to paid fea­tures un­til pay­ment is made.
  5. Re­newals: Fixed-price sub­scrip­tions au­to­mat­i­cal­ly re­new. You can dis­able auto-re­new­al at any time in your ac­count set­tings. Your ac­cess will con­tin­ue un­til the end of the paid pe­ri­od.
  6. Can­cel­la­tion & Re­funds:
    • Dis­abling Auto-Re­new­al: Your sub­scrip­tion will end af­ter the cur­rent paid term.
    • Im­me­di­ate Can­cel­la­tion (Fixed-Price): You can can­cel an ac­tive fixed-price sub­scrip­tion im­me­di­ate­ly. You may re­ceive a pro­rat­ed re­fund for un­used time, ex­clud­ing tax­es. The re­fund­able amount must ex­ceed 1 EUR/USD.
    • Non-Re­fund­able: Cred­its, one-time pur­chas­es, and plans marked as non-re­fund­able are not el­i­gi­ble for re­funds un­less re­quired by law or at our sole dis­cre­tion.

  7. Ter­mi­na­tion by SnapiX: We may ter­mi­nate or sus­pend your ac­count for vi­o­la­tions of these Terms, with or with­out no­tice.

5. SnapiX's In­tel­lec­tu­al Prop­er­ty

  • Our Li­cense to You: Dur­ing your sub­scrip­tion or ses­sion, we grant you a lim­it­ed, non-ex­clu­sive, non-trans­fer­able, re­vo­ca­ble li­cense to use the Ser­vice as in­tend­ed and ac­cord­ing to these Terms.
  • Our Own­er­ship: SnapiX and its li­cen­sors own all rights, ti­tle, and in­ter­est in the Ser­vice it­self, in­clud­ing its soft­ware, de­sign, brand­ing, and any im­prove­ments (ex­clud­ing your Con­tent). You may not use our trade­marks or lo­gos with­out our pri­or writ­ten per­mis­sion.
  • Feed­back: If you pro­vide feed­back or sug­ges­tions, we are free to use them with­out any oblig­a­tion or com­pen­sa­tion to you.

6. Pri­va­cy and Data

  • Data Col­lec­tion: We col­lect min­i­mal per­son­al data (like email and ac­count info) need­ed to pro­vide the Ser­vice.
  • Pro­cess­ing: Up­loaded im­ages, logs, and us­age data are processed as de­scribed in our Pri­va­cy Pol­i­cy to op­er­ate and im­prove the Ser­vice.
  • Your Rights (e.g., GDPR): You have rights re­gard­ing your per­son­al data (e.g., ac­cess, cor­rec­tion, dele­tion) as out­lined in our Pri­va­cy Pol­i­cy and un­der ap­plic­a­ble data pro­tec­tion laws.
  • Con­tent Dele­tion: Upon ac­count ter­mi­na­tion, we will take steps to delete your Sub­mit­ted Con­tent in ac­cor­dance with our Pri­va­cy Pol­i­cy and op­er­a­tional re­quire­ments.

7. Third-Par­ty Ser­vices

We use third-par­ty ser­vices to help pro­vide SnapiX (e.g., Cloud­flare for CDN/stor­age, Ver­cel for host­ing, Stripe for pay­ments, Clerk for au­then­ti­ca­tion, PostHog for an­a­lyt­ics, Sen­try for er­ror track­ing, Re­send for emails). While we se­lect these ser­vices care­ful­ly, we are not di­rect­ly re­spon­si­ble for their in­di­vid­ual ac­tions or fail­ures, though your agree­ment for the Ser­vice re­mains with SnapiX. Our use of these providers is fur­ther de­tailed in our Pri­va­cy Pol­i­cy.

8. Dis­claimers and Lim­i­ta­tion of Li­a­bil­i­ty

  • "AS IS" SER­VICE: THE SER­VICE IS PRO­VID­ED "AS IS" AND "AS AVAIL­ABLE" WITH­OUT ANY WAR­RANTIES, EX­PRESS OR IM­PLIED, IN­CLUD­ING WAR­RANTIES OF MER­CHANTABIL­I­TY, FIT­NESS FOR A PAR­TIC­U­LAR PUR­POSE, OR NON-IN­FRINGE­MENT. WE DO NOT GUAR­AN­TEE THE SER­VICE WILL BE UN­IN­TER­RUPT­ED, ER­ROR-FREE, OR SE­CURE.
  • NO GUAR­AN­TEE OF RE­SULTS: WE DO NOT WAR­RANT THAT THE QUAL­I­TY OR RE­SULTS OF THE IM­AGE CON­VER­SION WILL MEET YOUR EX­PEC­TA­TIONS.
  • LI­A­BIL­I­TY CAP: TO THE FULLEST EX­TENT PER­MIT­TED BY LAW, SNAPIX'S TO­TAL LI­A­BIL­I­TY FOR ANY CLAIMS RE­LAT­ED TO THE SER­VICE OR THESE TERMS WILL NOT EX­CEED THE GREATER OF (A) THE FEES YOU PAID TO SNAPIX FOR THE SER­VICE IN THE 12 MONTHS BE­FORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOL­LARS ($50.00 USD) (OR EUR EQUIV­A­LENT).
  • NO IN­DI­RECT DAM­AGES: TO THE FULLEST EX­TENT PER­MIT­TED BY LAW, SNAPIX WILL NOT BE LI­ABLE FOR ANY IN­DI­RECT, IN­CI­DEN­TAL, SPE­CIAL, CON­SE­QUEN­TIAL, OR PUNI­TIVE DAM­AGES (IN­CLUD­ING LOST PROF­ITS, DATA LOSS, OR GOOD­WILL) ARIS­ING FROM YOUR USE OF OR IN­ABIL­I­TY TO USE THE SER­VICE.
  • Some ju­ris­dic­tions don't al­low cer­tain dis­claimers or lim­i­ta­tions, so parts of this sec­tion may not ap­ply to you.

9. In­dem­ni­fi­ca­tion

You agree to in­dem­ni­fy and hold harm­less SnapiX (and its op­er­a­tor) from any claims, dam­ages, loss­es, li­a­bil­i­ties, costs, and ex­pens­es (in­clud­ing rea­son­able at­tor­neys' fees) aris­ing out of or re­lat­ing to: (a) your breach of these Terms; (b) your Sub­mit­ted Con­tent in­fring­ing third-par­ty rights; or (c) your mis­use of the Ser­vice or vi­o­la­tion of any law.

10. Changes to These Terms

We may mod­i­fy these Terms at any time. If we make ma­te­r­i­al changes, we will no­ti­fy you (e.g., via email or an in-app no­tice) rea­son­ably in ad­vance. By con­tin­u­ing to use the Ser­vice af­ter changes be­come ef­fec­tive, you agree to the new Terms. If you don't agree, you must stop us­ing the Ser­vice.

11. Gov­ern­ing Law and Dis­putes

  • Gov­ern­ing Law: These Terms are gov­erned by the laws of the Re­pub­lic of Bul­gar­ia, with­out re­gard to its con­flict of law prin­ci­ples.
  • Dis­pute Res­o­lu­tion: Any dis­putes aris­ing from these Terms or the Ser­vice shall be re­solved in the courts lo­cat­ed in the courts lo­cat­ed in Sofia, Bul­gar­ia. You con­sent to the ju­ris­dic­tion of these courts.
  • Time Lim­it on Claims: You agree to file any claim re­lat­ed to the Ser­vice or these Terms with­in one year af­ter the claim arose. Oth­er­wise, the claim is per­ma­nent­ly barred.
  • (Op­tion­al: Class Ac­tion Waiv­er) You agree to re­solve dis­putes with SnapiX only on an in­di­vid­ual ba­sis and not to bring a claim as a plain­tiff or a class mem­ber in a class, con­sol­i­dat­ed, or rep­re­sen­ta­tive ac­tion. (Note: En­force­abil­i­ty of class ac­tion waivers varies by ju­ris­dic­tion.)

12. Gen­er­al

  • En­tire Agree­ment: These Terms and our Pri­va­cy Pol­i­cy con­sti­tute the en­tire agree­ment be­tween you and SnapiX re­gard­ing the Ser­vice, su­per­sed­ing any pri­or agree­ments.
  • Sev­er­abil­i­ty: If any part of these Terms is found to be in­valid or un­en­force­able, the re­main­ing parts will re­main in full force and ef­fect.
  • No Waiv­er: Our fail­ure to en­force any right or pro­vi­sion of these Terms will not be con­sid­ered a waiv­er of those rights.
  • As­sign­ment: You may not as­sign these Terms with­out our pri­or writ­ten con­sent. We may as­sign these Terms with­out re­stric­tion.
  • Force Ma­jeure: We are not li­able for de­lays or fail­ures in per­for­mance caused by events be­yond our rea­son­able con­trol.
